1. Purpose
This Acceptable Use Policy (AUP) defines the rules and standards that govern how you may use Kobahost Web Services hosting infrastructure. This AUP exists to protect our clients, our infrastructure, and the broader internet community from harmful, illegal, and disruptive activity.
This AUP is incorporated by reference into our Terms of Service. By using Kobahost services, you agree to comply with this AUP in full. Violations may result in immediate suspension or termination of your account without refund.
If you are unsure whether something you plan to do is permitted, contact us at support@kobahost.com before proceeding. We would rather answer a question than suspend an account.
2. Prohibited Content
You must not use Kobahost hosting to host, store, display, distribute, or facilitate access to the following content:
2.1 Illegal Content
- Content that violates Nigerian law or the laws of any jurisdiction where your content is accessible
- Pirated software, movies, music, or other copyrighted material without authorisation
- Counterfeit goods or services
- Content that facilitates illegal financial activity including fraud, money laundering, or Ponzi schemes
2.2 Harmful Content
- Malware, viruses, ransomware, trojans, spyware, or any malicious code
- Phishing pages designed to steal credentials or personal information
- Content designed to exploit vulnerabilities in browsers, software, or systems
- Botnets or command-and-control infrastructure
2.3 Offensive Content
- Child sexual abuse material (CSAM) โ zero tolerance, reported immediately to Nigerian authorities and relevant international agencies
- Content that constitutes hate speech or incites violence against individuals or groups based on ethnicity, religion, gender, or sexual orientation
- Non-consensual intimate imagery
- Content that harasses, stalks, or threatens specific individuals
3. Prohibited Activities
You must not use Kobahost services to engage in the following activities:
- Hacking and intrusion: Attempting to gain unauthorised access to any system, network, or data
- DDoS attacks: Launching or facilitating Distributed Denial of Service attacks against any target
- Port scanning: Probing or scanning networks or systems without explicit authorisation
- Cryptocurrency mining: Running cryptocurrency mining scripts or software on our servers without prior written approval
- Proxy and VPN abuse: Operating open proxies or anonymisation services used to facilitate illegal activity
- Spam operations: Operating spam relay servers, spam-supporting services, or bulk email services not compliant with Nigerian spam law
- Resource abuse: Deliberately consuming excessive server resources that degrade performance for other clients
- Reselling without permission: Reselling hosting resources to third parties without a formal reseller agreement with Kobahost
4. Email & Bulk Messaging
Kobahost hosting accounts may be used for legitimate transactional and marketing email, subject to the following requirements:
- All marketing email must comply with Nigerian spam laws and, where applicable, the CAN-SPAM Act and GDPR
- All marketing emails must include a clear unsubscribe mechanism that functions immediately
- You must not send unsolicited bulk email (spam) from our servers
- You must not harvest email addresses from websites or use purchased email lists
- Transactional email volume that exceeds normal website activity may require upgrade to a dedicated email delivery service (Brevo, Mailgun, etc.)
Important: We do not provide email hosting as a bulk mail relay service. Accounts found to be sending spam will be suspended immediately and reported to spam blacklist authorities.
5. Resource Usage
Our shared hosting plans operate on shared server infrastructure. To ensure fair resource distribution across all clients, the following limits apply:
- CPU: No single account may consume more than its fair share of CPU resources on a sustained basis. Accounts causing consistent CPU overload may be throttled or asked to upgrade.
- Memory: Scripts and processes are subject to PHP memory limits as specified per plan.
- Inodes: Each account is limited in the number of files it may store. This limit is enforced to maintain server performance.
- Concurrent connections: Accounts generating excessive concurrent connections may be rate-limited to protect server stability.
- Cron jobs: Cron jobs must not run more frequently than once every 15 minutes without prior approval.
If your website's resource requirements consistently exceed what shared hosting can support, we will recommend and assist with upgrading to an appropriate higher-specification plan.
6. Security Responsibilities
While we maintain server-level security, you are responsible for the security of your hosted applications and content. Your security responsibilities include:
- Keeping WordPress, plugins, themes, and all CMS software up to date
- Using strong, unique passwords for your hosting account, WordPress admin, and database
- Not sharing your hosting credentials with unauthorised parties
- Removing unused plugins, themes, and applications that could introduce vulnerabilities
- Monitoring your website for signs of compromise and reporting any suspected security incidents to us immediately
We reserve the right to suspend any account that is actively compromised and posing a security risk to other clients or our infrastructure, even if the compromise was not caused by the client's negligence. We will work with you to restore access as quickly as possible once the threat is resolved.
7. Reporting Violations
If you become aware of content or activity on Kobahost infrastructure that violates this AUP, please report it immediately:
- Abuse reports: abuse@kobahost.com
- Security vulnerabilities: security@kobahost.com
- CSAM reports: We report all CSAM to the Nigerian Police Force Cybercrime Unit and the Internet Watch Foundation (IWF)
All abuse reports are treated confidentially. We investigate all reports and take action where violations are confirmed, typically within 24 hours for serious violations.
8. Enforcement
When we determine, in our sole discretion, that an account has violated this AUP, we may take one or more of the following actions depending on the severity and nature of the violation:
- Warning: We may issue a written warning and require corrective action within a specified timeframe
- Content removal: We may remove specific content that violates this AUP
- Temporary suspension: We may temporarily suspend your account pending investigation or corrective action
- Permanent termination: For serious, repeated, or wilful violations, we may permanently terminate your account without refund
- Legal action and reporting: For serious violations including CSAM, hacking, or fraud, we will report to appropriate Nigerian law enforcement and regulatory authorities
We will make reasonable efforts to notify you of any enforcement action and the reason for it, except where notification would compromise a security investigation or legal obligation.
